Legal Question in Real Estate Law in Pennsylvania
Refinance home loan
My husband and I are separated, but own a home together. I currently live in the home - can he refinance the mortgage without my knowledge or permission?

Re: Refinance home loan
Depends...are you on the deed? Or is the property solely owned by your husband, if it is, yes he might be able to refiance the property, because you would be considered nothing more than a tenant according to the bank. Also when was the house purchased prior to your marriage or after?

He can technically mortgage any ownership interest he has. As a practical matter I know of no mortgage company that would grant a loan like this.
