Refusal of Land
A pays B $1000 for a one year option to buy five acres of land. Ten months later the value of the land has doubled, and B suddenly dies. B's executor refuses to sell the land to A, claiming that B's death terminated the offer. Who prevails?

If the option is in writing and signed by the decedant, then you can enforce the option. I suggest you consult with an attorney. If it is not in writing you may have a problem with enforcement. That is why I suggest legal counsel would be helpful. Gerald Hershenson Esq. 215-579-9390
