Remove a name from Deed of Home

What form do I use to remove my husband's name from the deed to our house. I know you can't change a deed and need to record a new one. We want the deed to only have my name on it.

There is no form...you are going to need to pay an attorney to draft you a new deed. But you can only have a new deed drafted and recorded with the permission of your husband. Basically if he doesn't sign off on the new deed you can't do it...and if you forge his name or don't include it in the deed your title to the property will be jeopardized.

The question is why do you need his name of the deed. It is what determines what you need to do.

If its due to a divorce you need to have him give you a quitclaim deed. Basically a deed that says I give up whatever claims I had to the property though it does warrant that he had any claims. You then go file that with the register of deeds.

If its because he is deceased and you owned the property as a married couple. Then get a quitclaim deed from his executor and file it with the register of deeds.
