I need to rent out my condo- The condo board won't allow it! Help me Please

Hello:

Here is my issue. I was recently laid off my position at Toll Brothers this past January 2009.

I worked as a Sales Associate there. My husband and I live in a high rise condominium here in Philadelphia. Our plan was to rent out our unit and live with my parents till I become financially stable again. The condominium board refuses to do this. They will not grant me a leasing permit for me to rent out my unit. I feel stuck. I am currently on unemployment and it ends in August. Do I have a chance to have a case here and actually win?

Probably not - if you read your condo documents carefully, there is probably a prohibition against renting.

You may be able to make a hardship application. This is not a right you have, but make the request. Talk to the board members to find out what your options are.

If you are able to rent to a stable tenant who will pay and provide a security deposit, the condo board may prefer that your condo fees continue to be paid out of the tenant's rent to you, rather than your defaulting on your condo fees payments.

Any lease would have to include the tenant's responsibility to observe all condo rules and regulations.

You may have to sell the unit, if you cannot rent it.
