Legal Question in Real Estate Law in Pennsylvania

responsibilty to property deed

I bought a home with my partner one year ago. I am on the deed with my partner. I am NOT on the morgage. I moved out in May 2008. The relationship turned out to be a nightmare. What am I responsible for? Can my partner keep threatening to take my to court for half the morgage?

Re: responsibilty to property deed

I assume you did not have a written partnership agreement which spelled out the respective rights liabilities of each of the parties in your financial endeavor. While you are not liable on the mortgage to the Mortgage holder, as a co owner you may be responsible for costs expended in managing or upkeep on the property. This may be by virtue of a partition action to divide and sell the property. You should immediately seek legal advice and contact an attorney to help you with this matter. If you would like to schedule a consultation with my office then you can contact me to so schedule.
