Return of Lease Deposit

I signed an apartment lease on sept 5th and i gave the landlord $750 for deposit. Then on sept 10th, we decided not to rent the apartment anymore. The lease was to start on Oct 1, 2008. The landlord refused to return the $750 deposit, even knowing that the lease starts oct 1. What can i do?

Read your lease.

Once you sign a lease, it is a contract, and unless it gives you the right to cancel, you are obligated to pay rent for the term of the lease. The fact that you changed your mind a few days later does not change your obligations.

The best you could do is to negotiate with your landlord about not having to pay the rent for the entire term and getting a written release saying that your obligations are ended. The landlord may allow this if you pay a smaller amount than what the full term would be.

If you do not come to an agreement with the landlord, the landlord may sue you, resulting in a negative effect on your credit.
