Legal Question in Real Estate Law in Pennsylvania

Can an old roomate be sued for back rent?

An old roomate has not paid any rent for the past two years. They finally moved out this month and will not pay any of what is owed. Is it possible to take this person to small claims for payment if their name was included on the lease?

Re: Can an old roomate be sued for back rent?

Yes,

You have grounds to take to him to court. You will need proof of his financial obligation. Was he on the lease or any of the utilities. What proof do you have that he lived there and what was his share of the rent there. Small claims court does some flexibility in how you present the facts, however there is no substitute for good documentation.

Your roomate can be sued for back rent. However, more information is needed in order to properly advise you. You can file a claim in small claims court. If you would like more detailed information, I suggest you contact my office at 215-579-9390
