Legal Question in Real Estate Law in Pennsylvania

Want roomer to move out.

There is a male person living in my home that is not abiding by the rules that I require for him to live here. He has lived here at different times over the past 8 years. There is not written agreement (just a verbal understanding) and he is not permitted to smoke (I get sinus infections from smoke and tobacco smells), not permitted to do drugs, or drink (he is an alcoholic) while living here and also must pay $200 weekly for extra bills, laundry, food, etc. He is breaking these rules and I have told him to get out and he refused to go. He gets very verbally abusive and also has gotten physically abusive. He also owes me $2060.50 at this point. I have spoken to the police in my small town and they tell me that I have to evict him - that could take a long time. Do I have to evict him or can I just move him out? I need to feel safe and secure now and am afraid to wait for an eviction period. I do not want to get a PFA; he has had enough problems in his past and since I have done my best to help him recover from his alcohol problem, I just want him to get out of my home. What are my options?

You have two options:

1.) File an eviction and go through the legal process to guarantee that your "tenant" or boyfriend be prohibited from entering your property

2.) (I DO NOT RECOMMEND THIS ACTION)Change the locks and remove all of the roommates property to a safe and secure location (storage facility) and give him access to the property. Please be advised that this would be consistent with a self-help eviction and illegal in PA, you in turn could be sued and forced to allow your "tenant" back into the property...however, if this roommate is nothing more than an invited guest you might have a defense, but if as you stated you are being abused then you need to take immediate action!

An eviction proceeding does not take that long as the court must schedule the hearing within 2 weeks. The fisrt step is to give a 10 day notice to quit and if he refuses to leave you would file suit. I offer free consultations.
