Legal Question in Real Estate Law in Pennsylvania

Seller Disclosure Statement

Seller claimed on Disclosure Statement there was no current or prior water leakage accumulation or dampness within basement...etc.

Upon moving in August 2001, there was an immediate water problem in the basement (family room). Heavy rainfall causes water coming through one wall. Adjustments have been made, like cleaning downspouts, etc. but nothing helps. Professional estimate $3300.00, not including carpeting, etc.

Responsibility? Real Estate co. and/or seller? How best to pursue? Any time limitations on buyer?

Re: Seller Disclosure Statement

You may want to consult with legal counsel. If the Seller failed to disclose a defect that was known, you will have to file a law suit to collect if there is a refusal of payment. The broker, home inspector and former owner are potential defendants. You can file in small claims if you desire. However, seek legal advise first. Gerald M. Herhenson Esq. 215-579-9390
