Re: selling your house

If both names [husband and wife] are on the legal title to the house [the deed by which they bought the house, the answer is No, but....

If the couple can't agree, they will end up suing each other, squandering their assets on legal fees, etc.

It would be best to come to some kind of written agreement about selling the house and how the net proceeds will be divided, or consulting with lawyers about legal separation and/or divorce, including a property settlement agreement that covers the house as well as all other marital property.

Each person should have his/her own lawyer, because there is an inherent conflict of interest between them.

An agreement of sale signed by only one owner, if there is more than one, is not sufficient to require the other owner to join in a deed to the buyer.
