Seperated and forclosing on the house
I have been out of the family house for over 1 year and my husband is not making the mortgage payments. I am the co signer of the loan and the home is in the forclosure process. I want to keep the home but I don't want to make a payment while he is still living there. What rights do I have as a co signer and what do I need to do to get him out of the home so I can save it and what little credit I have left.

As unfortunate as it may sound you are equally responsible for the property, regardless of whether you live there or not! This means your credit score / history is currently being destroyed by the current ongoing action. You are also civilly liable for the debt on the property. You need to immediately retain counsel!

I suggest you immediately contact an attorney. You must obtain title to the property in your name alone and your husband must relinquish his interest.
