Legal Question in Real Estate Law in Pennsylvania

Sherrifs Sale

I am considering a purchase of a home that is up for Sherrifs Sale, however, the property has a lien against it in the amount of $12,138.08. Who is responsible fo this debt? Am I assuming this debt or would the money from the Sherrifs Sales pay it?

Is there any Law in Pennsylvania that I can reference?

You must be very careful. If the lien is the mortgage that is subject to the sale, the lien will be paid off out of the bidding proceeds. If the lien is not subject to the mortgage foreclosure it may or may not be paid off. I suggest you have an attorney review you effort and the title report to make the determination. If there is first mortgage that is subject to the sheriff sale the lien would be discharged and not have to be paid. The complexity of the sheriff sale bidding process could result in great risk to you. Become informed and educated or suffer a loss.
