Legal Question in Real Estate Law in Pennsylvania

three siblings had a home given & put into all threes names. Two want to sell, & one does not. one that wants to sell is having a partition for separation started against the one that did not want to sell to force the sale. One sibling did not go in on it but wants to sell. Could the one thats being filed against just buy out the one thats suing without the third siblings approving?

If they are tenants in common, then each may sell his or her 1/3 to another, and the buyer would then own 2/3. It shouldn't require the approval of any other co--owner.

You'd all be better off settling this among you, or agreeing to sell the property and divide the proceeds equally. A court action will eat up a lot of whatever equity the property has, leaving less for the siblings to share.
