sold property

we sold a 1/2 acre to our neighbor in which was adjoining his property on the county map. A business recently bought other property in the immediate area and had all the deeds researched and found that the deed to the 1/2 acre we sold to our neighbor is actually the deed to our driveway, and is not ever close to our neighbors property. the question is, are we able to get the get, or buy the deed back from our neighbor. Is there a legal way to get it back if he is giving us problems in returning or selling the property back to the original owners?

You asked about correcting an error in a conveyance of real property.

Let me guess, you didn't use an attorney. Guess what, it's going to be a bit of time to clean up this matter and may or may not involve a lawsuit.

It would seem that the neighbor wants to have the deed to the piece of property he originally purchased. You have what he wants and he has what you want. It should work as an even trade.

If he doesn't want to play that way then you also should play hardball. What did he want that property for originally? Probably to avoid the need for a variance. You could always seek to enforce zoning against whatever use he has put the property.

No matter, you need to bring this matter to a local attorney to correct what has been fouled up. If in the off chance that the matter was originally handled by an attorney then that attorney should clean up the mess.
