Spouse Moves Out

If husband and wife are jointly listed on the deed to the house and the wife packs up and leaves without the husband knowing it while husband is at work, what rights if any does the wife who moved out have as far as entering the property if husband has changed locks or similar occurance. Also what rights does remaining husband have as far as the house is concerned and reclaiming any property wife may have taken with her.

Wife may enter the house. She is still a legal owner and may obtain a locksmith to open the door. As far as the property removed, in a divorce proceeding any property removed will be considered in an equitable distribution hearing. Rentry although perfectly legal may be a bad move that could lead to a revengeful attitude. There should be something of value that would justify such a entry. Suggest you contact a lawyer immediately.
