I was sued by a home owners association for dues and fines. The fines were rescinded does the whole case get thrown out

If a law suit was filed, it has to be withdrawn by the party that filed it, or settled and "discontinued". Until it is dismissed for lack of prosecution [which means that no one took any further action], the case remains open.
