Legal Question in Real Estate Law in Pennsylvania

tenant privacy

My daughter rents an apartment while attending college. Landlord representative walks into apartment without proper notification? Yesterday my daughter was halfway undressed while getting ready to shower. What rights do I have?

Re: tenant privacy

You asked privacy of a tenant.

First of all, you have NO RIGHTS. This is your daughter's apartment and any rights are limited to her.

A landlord has a very limited right to enter premises leased to a leaseholder. Generally they must either have permission or have given reasonable notice, exigent circusmtances would also be permissible but should extremely rare (e.g. only to protect against imminent harm to life or property.). Generally, rented premises are subject to the exclusive use of the lessor.

I would suggest having an attorney draft and send a letter to the landlord to prevent this activity from happening ever again. I would also consider filing a report with the police. What happens after that is not her consideration. But they must at the least accept and file the report. If it happens again I would suggest aggressively pressing charges for trespass. Depending on the circumstances I might also have the apartment checked by a private investigator.

Regards,

Roger
