The more important question is , whose name is on the deed. If it is in both names you are co-owners and either party can force sale of the property through a Partition action. if her name is still on the mortgage as well as your name that means both of you are obligated for the mortgage. If you have been living in the house since the divorce andpaying the mortgage and taxes and maintenance then it is possible you can claim credit for htese expenses in a partition action. You should speak with a attorney to determine what your goals are concerning the house.
