Legal Question in Real Estate Law in Pennsylvania

Writ of execution

Attorney sent me a writ of execution pertaining to an unpaid credit card. Does this mean they are going to sell my property at sherriff sale? I owe 45,000 on the home. they only need 3,000 for the credit card delinquency. Does this mean they have to sell the home for my mortgage balance which is 45,000 to satisfy the mortage?? The they get there $3,000??? Please help. Thank you

Re: Writ of execution

Potentially though probably not your house. They can go after a lot of other personal property such as bank accounts, cars, and the like. There are a number of things they can't sell.

On top of the $3,000 they can also recover the cost of the sheriff selling your property. It might be a good idea to either come up with the $3000 and pay them off or see if you can get them to allow you to make arrangements to pay the $3000. Though don't expect they offer any great payment plans.
