The way you asked the question is odd and the answer to that question is, yes, it is legal for her to give it. BUT, BUT, BUT, it is illegal for him to accept it. It's called statutory rape and there is absolutely no defense. Sexual contact with an underage person with a person more than two years their senior is statutory rape (on the part of the senior party).

Statutory rape is a felony. A statutory rapist will go to prison (not jail) and will not be treated well while there: by the other prisoners or the guards.

If this question is posed by the underage girl then you MUST report this person to the police and your parents immediately. No questions. This is not only an improper request but is illegal and is taken very seriously by the authorities. And since this question was posed under the sexual harrassment header I am guessing that the older male has made an improper request or demand. Even between people of similar ages it is illegal for a person to use any color of authority or power to solicit sex in any form.

If this question was posed by the guy, then you need to distance yourself from the relationship and if you were considering it, get counseling. A 15 year old cannot consent to sexual relations with an adult in any way shape or form.
