Legal Question in Sexual Harassment in Pennsylvania
One of our employees sent a picture text message with a caption to another co-worker (a nude obese drunken passed out female, "She should have learned to handle her liquor."). The co-worker complained that it made her uncomfortable. The sending employee was verbally reprimanded immediately following the complaint with instructions that this could never happen again. Was this handled properly? This picture sending/receiving did not happen in the office.

While your description reflects appropriate handling under these circumstances, your efforts should not stop with the warning. You should undertake further investigation to include speaking with the person who was offended to determine whether other sexually harassing communications, comments or innuendo previously occurred with this employee.
