It depends where you are. If you are in philadelphia county, you can bring a cause of action for this kind of hostile work environment. At minimum, however, first you must COMPLAIN, IN WRITING to your supervisor at work. Keep a copy of the complaint. Feel free to call us at our offices or e-mail me directly with any other questions.

Before you can file a lawsuit, you need to complain in writing about this conduct. This should be directed to your supervisor. If your company has a written policy regarding harassment, make sure to comply with the terms of that policy when advising your superiors of the matter. If you do this and the conduct continues, you may be able to bring a lawsuit for "hostile work environment" and for other causes of action in addition, depending on the facts. If you would like to discuss this in person, please contact my partner, David Dessen, at 215.496.2902 or by e-mail at [email protected] and he will be happy to offer you a free consultation at our office in southeastern Pennsylvania or a free consultation by telephone. He has handled many cases of a similar nature. Do make sure you keep a copy of your complaint and document what steps you took to advise your company of the problem.
