Legal Question in Sexual Harassment in Pennsylvania

Proof of harassment without corroberating witnesses

I am being sexually harrassed at work and it has been going on for approximately 6 years. The problem is that due to the nature of the work situation, I don't think I could get any co-workers to coorborate my accusations. I want to know if it is possible to win a case of sexual harrassment under these special circumstances. It has been a very painful way to live.

Thank you

Re: Proof of harassment without corroberating witnesses

It is harder to prove harassment without witnesses but it can still be done. However, if you haven't filed any complaints with your superior or the company that you may have a problem. In order to hold a company liable for its employees actions you have to show that they knew about the problem but they did nothing to stop the harassment. You need to start documenting everything i.e. date and time of harassment, name of harasser, names of people who may have over heard the harrassment, type of harassment and the name of the person whom you notified. If you notify your superior and nothing is done than you need to notify his superior. Make sure that if you notify your superior in person you follow up with a letter stating what happened and stating that you spoke with him about the harassment for example: " Dear Mr. Smith I spoke with you this afternoon about the situation that has occurred. Yesterday, so and so did this and it made me uncomfortable." If something still isn't done than you should start thinking of filing a complaint. If you have EEOC in your state you need to start there and file a formal complaint. They will then decide whether or not to investigate. Either way they will send you a right-to-sue letter. Once you get this letter you can file a civil suit. Now, I do not practice law in your state so the laws may be different. I recommend that you consult with an attorney who handles harassment cases. If you need a referral call the county or state bar association. They can refer you to a good attorney in your area. Most attorneys offer free consultations.

Good luck.
