Legal Question in Sexual Harassment in Pennsylvania
Sexual Harassment
I am a woman who works with mosstly men, one of them decided at lunch time to just get up and kiss me on my cheek. The gesture was not welcomed and I am having a hard time returning to work. I can't sleep and I am having violent thoughts. This happened to me before on this job and the company did nothing about it. What can I do about this?

You should also be sure to go to your doctor about the anxiety that you are feeling. Tell him/her about it, and make sure you get a referral to a psyche and all treatment that you may need. You should do this as soon as possible so that there is documentation of your mental damages. Again, feel free to call.
Re: Sexual Harassment
I haven't had one of these cases for a while but I recall one a number of years ago where there was some type of case holding that if a company had a written policy in place regarding this you had to follow the procedures in the company policy prior to bringing an action. I think that case involved an unemployment compensation case, though, where my client left her employment and I'm not sure if that applies to your situation. The first thing that I suggest you do is report the incident in writing to your immediate supervisor.
Re: Sexual Harassment
You should definitely consult with an attorney. Based upon these facts alone, you will likely have a sexual harassment claim against your employer. Furthermore, they cannot retaliatorily fire you for submitting a claim. We handle these cases. Feel free to give our offices a call. These cases are typically taken on a contingent fee basis, which means there is no recovery unless you win.
