Legal Question in Sexual Harassment in Pennsylvania

Statute of limitations on Sexual Harrasment Cases

I am wondering if you may tell me what the statute of limitations is on a sexual harassment case. The complaint was filed with the pennsylvania dept of human relations a year ago. We have heard nothing of it since. It was last November that we met with a hearing officer to defend ourselves and we were told the situation would be investigated. We have heard nothing since and our attorney isn't much help.

Thank you!

Re: Statute of limitations on Sexual Harrasment Cases

If a charge of discrimination is timely filed with the PHRC (generally 180 dys from the act of discrimination), the commission has one year to act on the complaint. After the one year period has expired the Commission must notify the complainant that they have a right to pursue their claim in the courts. The complainant has two years from the date of that notice to file a court action.

Please call to discuss. It's not really fair to

second guess another attorney without more information.

Generally, the administrative charge must be filed

within 180 days of the ocurrence. The PHRC takes time

to react, investigate, and conclude its investigation.

Call the PHRC yourself if you are more curious.
