Legal Question in Social Security Law in Pennsylvania
I don't know if you can even answer this, since it's not for me. I have a friend who is trying to get Social Security Disability. If anyone deserves this, it's her. She has a number of medical problems, including a flesh-eating disease. The lawyer she has now is trying for the second time to get her qualified. I'm guessing that she tried once on her own and was denied. Now she's been denied twice WITH a lawyer. Some of her other friends and I feel this lawyer isn't doing his job. We've suggested that she find another lawyer. She told us that she not allowed...that she has to stay with this lawyer, because of a contract. That as long as he's fighting for her, she is obligated to stay with him. He's told her this time could take as long as two years to get an answer. I'm sorry, I just can't believe this. I wish I had a copy of this so-called contract, but I don't. Here's my question: Does she HAVE to stay with this lawyer??? If he has tried twice and can't help her, what good is he doing for her? Even criminals have a right to fire one lawyer and hire another. I am very concerned for my friend and her 10 yr old daughter. I would appreciate any advise you can give. Thank you.

A Social Security claimant can fire a representative at any time. However, just because she has not yet received benefits, does not mean her attorney is not doing his job. Most people need to appeal several times. SS Disability is difficult to get and can take many years.
