Appeal Hearing Fees

If an attorney waives the $5300 max, what fee could I consider to be reasonable for representation at a social security disability appeal hearing?

25% of your past due benefit is considered a reasonable fee according to the regulations and case law. Note that the maximum fee has been raised to $6000 as of July.

If you and your attorney do not use the Fee Agreement process, you attorney needs to file a Fee Petition and request a specific amount for a fee.

The reasonableness of the fee is a decision of the ALJ based on the time and effort after of your attorney.

So if the time and effort is little, the fee may be lower than 25% of your past due benefits; but if the effort is small you may not win.
