Legal Question in Social Security Law in Pennsylvania

Is my child eligible for ssi benefits?

My daughter is 8 years old. Her father, who does not live with us receives ssi benefits. I have full custody of her. He is not required by law to pay any child support at all. I was told by personal several sources that she should be eligible for a monthly benefits check. I was going to go to the social security office to apply for benefits for her; but I would be greatful for some advise regarding this matter before I actually make that move.

Re: Is my child eligible for ssi benefits?

First, I do not understand what you mean by "He is not required by law to pay any child support at all." You must review this issue with a domestic relations lawyer. I have several clients who receive SSI and are required to pay child support(albeit a very small amount)

If the child's father is receiving SSI, there is no derivative benefit for a minor child. SSI is a program for people who have not worked and have not paid FICA or Social Security tax.

If the child's father worked and paid into the SS system and is receiving "Disability," then the minor child should be elligible for a benefit. Contact your local SS office to open the claim.
