Legal Question in Social Security Law in Pennsylvania
disability
I am 50 yrs old. I have degenerative disc disease. 2 years ago i had 2 herniated popped out discs. Have never fully recovered and have not been able to work. I have 30 credits towards SS, but you need 40 to get SS,disability etc. My question is, would i be able to get disability from social security? It does qualify as a lifelong disability according to their qualifications.

Re: disability
You got some wrong information regarding the number of quarters needed for disability at age 50. Check out this table from the SSA website: http://www.ssa.gov/dibplan/dqualify3.htm As you can see a person needs just 28 credits to be eligible for disability at age 50; 20 of those credits need to be in the 10 years prior to the onset of disability.
If you can't do the sort of work you have done in the past, and are limited to unskilled sedentary work (or less), you should definitely apply for disability benefits.

1. A clear diagnosis is important but more important is documenting your loss of function. You, and your doctors, need to document inability to perform any full-time, competetive work.
2. re: credits - you need 20 out of the last 40 quarters - or generaly, 5 out of the last 10 years work.
You should file a new claim and tell the SSA that your onset date of disability was several years ago when you last worked.
