Legal Question in Social Security Law in Pennsylvania
Hi
I was approved for social security benefits in 1996. I had previously received a lump sum workers comp settlement. The lump sum amount expired in August 2006. I however was never given an increase in my monthly benefit other then the cost of living raise. When I discovered this I contacted Social security they said that I was already receiving my max benefit. And if so why did they calculate my monthly benefit off of my monthly workers comp benefit instead of my actual wages i had enough credit years. I,v read the average sdi benefit is around $1000 or more , mine is only in the 600"s and when I first stated getting I only received 464.00.

SSI is more around $700.00. It is not as high as $1,000.00. To determine whether you are getting your max benefit rate or whether your benefits were reduced because of the settlement would require analysis of your WC documents and a request for certain information to SSA.
