Legal Question in Social Security Law in Pennsylvania

I receive social security disability. My estranged husband claims that he's entitled to half, even though I have full custody of our child, and he pays no child support. Is this something I need to worry about?

Are you receiving Disability or SSI? There are no auxiliary benefits for SSI. If you receive SSD, your child is eligible for an auxiliary benefit but your estranged spouse is not. Does you child get a benefit too? If not, contact SSA to see if your child can also get benefits.

You should consult with a family law attorney about your rights to child support and other issues. If you are on disability, you should be eligible for a pro bono attorney through your county Legal Aid.
