risks regarding disability benefits

My ex-husband collects full permanent disability. My son as a result, receives a check once a month. My ex is working full time and not reporting it to S.S. office. If and when he is found out, will I(my son) owe all the money back that we have been receiving? Also, can I be held legally responsible for not reporting it, ie: be fined and or arrested?

The good news is that there is no mandatory snitch law - so you will not get in trouble for not reporting his fraud. But you need to decide what is the right thing to do here.

Anytime someone receives a benefit that they should not have received and the SSA finds out, the person who received the benefit will be charged with an Overpayment. SSA will make demands for re-payment even though you and your child are not at fault.

If you check through other Social Security questions posted here over the last year, I believe you will find a posting by young man whose mother received auxiliary benefits for him as a minor from his disabled father's account. For some reason SSA found the payments improper and demanded that he re-pay - even though payments were made to his mother several years earlier.
