Social Security Disability

If someone is defrauding social security and is caught, what are the consiqueces and can their spouse be held accountable?

This is a very difficult question to answer because you have not provided any specific facts. I am sure you agree that if someone is receiving money he knows he should not be receiving, he will eventually be in trouble. In most Social Security matters, he will be made to pay back the money.

If, for example, this is a matter of someone continuing to receive disability benefits after returning to work without advising SSA, the penalty may be only a cessation of benefits and repayment.

But if this involves receiving benefits you are not entitled to due to some falsification of the record, there may be criminal charges, in addition.

For the spouse, again you give no specific facts. So, it depends on whether the spouse is or was actively involved in the fraud or simple knows about.

SSA has a fraud investigation unit called the Office of the Inspector General (OIG).
