Legal Question in Social Security Law in Pennsylvania

SSDI, LTD and child support

Just approved for SSDI. LTD states repayment is owed from back pay from lump sum SSDI. My son is 16 living with his father. There is already and offset from my APL STBX pays me and my CS I owe him. 1 order STBX pays me balance after his CS is payed to himself.

Will my lump sum dependant portion of my SSDI go to my STBX because if so, I will never see it to pay back my LTD. They want that money back. Will SS send me two back pay amounts? 1 for me and 1 for my son to his dad? Also, how would that work if my son got his own SSI now? or I mean his dad got it for him? How would that effect my SSDI?

Re: SSDI, LTD and child support

If there is an offset from your alimony pendente lite for the child support then there shouldn't be any back child support due. The lump sum portion of you back Social Security Disability dependent's share will most likely be sent directly to your soon to be ex-husband as representative payee for your son as well as any ongoing SSDI payments. You have to have someone take a close look at the provisions of your long term disability policy because the insurance company may not be entitled to repayment for the back benefits although they will take it if you voluntarily pay it.
