Legal Question in Social Security Law in Pennsylvania

survivor benefits

In 1996 I found out my duaghters father had passed away.I found out when he did noy show up for the child support hearing. I tried to apply for benifits for her. Becuase there was no legal proof of paternity my claim was denied, although his brother signed an affidated stating the truth of paternity,

Recently, june, I thought if i reopened, the claim with the files from child support, that may be enough proof.

Luckily it was. now the problem i am having isi am told he does not have enough credits. the firsy time i applied i was quoted an amout of the benifit shewould be recievig

I am not sure all the legalities, but I do know she can still collect a benifit

please let me know my options regarding this matter

unfortunately, social security survivor benefits is often time a MONUMENTAL legal hurdle to "jump" all on your own, as a layperson. more or less, the administration is "trained" to deny claims at all cost, which makes sense based on the state of array the finances and department are in on the whole, and facing certain bankruptcy in the fairly near future. your best bet is to retain a lawyer to do this for you, as they typically get results that laypersons couldnt dream of when dealing with this department. we have had numerous clients who were unable to get in the door per se, without an attorney intervening. hope this helps.
