Legal Question in Traffic Law in Pennsylvania

Driving while under dui suspension

I was recently cited for driving while under DUI suspension. I was not DUI at time of this citation.

The ticket is for statute 1543b. Which (from my research) does not state a penalty of 1 additional year of driver's license suspension. However, 1543c (which is not written on the citation) does. Do I have a leg to stand on? Or do I lose my license for 1 more year?

Thank you

Re: Driving while under dui suspension

Unfortunately - YES, you still lose your license. You would not receive a citation for a violation of 75 Pa. C.S. ยง1543(c) because that subsection directs PENNDOT to suspend your license "Upon receiving a certified record of the conviction of any person under this section. . . . "

You may still have hope however, often the circumstances of the citation provide defenses - especially for defects in violation of your rights. Feel free to contact me if you need additional help, I offer free consultations and reasonable legal rates.
