Hit and run accident

I was involved in a accident , which was not completely not my fault. this was my 1st accident and i did not know what to do. I asked the other driver did he contact the police. He said no , so I left the scene, not taking any information and took my daughter to the hospital because she hit her head. I thought I would just take it as a loss. The other driver reported a hit and run to his insurance company, now they are taking me to court to pay for the damages for his car. Is there any way I could possibly fight this case and win or pay and take it as a big loss?

If you have insurance on your car, your insurance company will pay for your attorney and likely cover any damages to be paid out. You should immediately report this to your insurance company. Your daughter also will have a claim for her injuries, although if you are partly at fault then part of the claim would actually be against you.

Since the other individual indicated he was not contacting the police, then unless he appeared to you to be injured and in need of immediate medical treatment, this is absolutely not a "hit and run".

So, the short answer is that you seem to have a chance of fighting this and winning. I can't put odds on it because the ultimate answer is fact-bound and depends on the totality of the circumstances of the case.
