Legal Question in Traffic Law in Pennsylvania

illegal stop?

I'm hoping someone can help me out here. I was recently pulled over for driving without a license. My question is I was driving a vehicle that was not registered in my name so when he ran the plate it would have come up on the other persons name for the registration. How can he pull my over and say I'm driving without a license if my name never came up on the plate? Was this an illegal stop?

Re: illegal stop?

If he had no other reason to pull you over (expired stickers or tags) you may be able to fight the citation. I recommend speaking with a lawyer. I offer free consultations.

Re: illegal stop?

It depends. Perhaps he knew who you were and knew you didn't have a license. Perhaps you did something else that was a violation of the vehicle code that justified the stop. If the plate was current, if the inspection sticker was current, if he didn't know you, and had no other reason to stop you, then it's possible that you could challenge the charge.
