Legal Question in Traffic Law in Pennsylvania

Passsing two police vehicles parked on the side of the road

Near State College, my daughter slowly passed three police vehicles and another vehicle parked on the side of the road. She was chased by one of the police vehicles and given a sitation for not moving to the left lane. It was a four lane highway. Multiple cars passed by without being stopped and the officer said she was the unlucky one. It was obviously a setup to make money from students returning from spring break.Officer said don't contest it since she was video taped. Should she plead not guilty since she was unaware of any law and a max fine of $220 is unreasonable for this offense. This is her first ticket. She is 19.

You asked about a traffic citation.

Always fight a traffic citation. Never make a statement to the issuing officer. This would be a good learning experience for her.

She should look up the law and various cases about the enforcement of this provision. Was she able to move to the left? Safely? What were the traffic conditions? What was the actual situation? Was it actually a set up or was there a legitimate reason for the vehicles to be where they were? As to the last then my suggestion would be that it actually is a revenue generator and should be challenged as such.

There are numerous books and Web sites that discuss how to handles traffic tickets. Especially as in this case where it seems like a scam.
