Legal Question in Traffic Law in Pennsylvania

Pedestrian Injured By Auto After Running Into Steet

My friend was driving at night and a pedestrian ran out into the street and by the time she could hit the brakes, the car hit the pedestrian. It turns out that it is a child. Does my friend's automobile insurance have to cover the child's medical expenses or does the child's parents have to submit theirs from their auto insurance or medical insurance? The police did not issue any papers at the scene for the driver to sign and said it was alright for her to drive back home after the incident. The cop said they will get back with her soon.

This is nothing about anyone being at fault yet.

If the parents have an automobile and insurance theirs would provide the first medical payments. Only if the parents were not the owner of an automobile would your friend's PIP coverage be the first insurance to make payment. I offer free consultations.
