Legal Question in Traffic Law in Pennsylvania

Question about establishing residence and getting your license

I am 16 years old and live in NJ where the driving age is 17. My father lives in PA where the age is 16. Can i establish residence with him in PA, get my license there and still stay in NJ? I go to a private school so not being a resident of the town is not a problem.

Re: Residency for drivers license purposes

You are permitted to obtain a license in the state where you have your legal domicile. It appears that your parents may be divorced. The custody agreement between your parents would control your domicile in that case. In most cases, this would be the place where you spend the majority of your overnights. Keep in mind that this advice is based purely on the little bit of information that you have given to me. There may be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained. Since it appears that you have not retained an attorney, you may want to consider speaking with the Division of Motor Vehicles in Pennsylvania to see if they believe you qualify. And of course be sure that both your parents are in agreement with your decision. Good luck!
