Legal Question in Traffic Law in Pennsylvania
Slowing Down Tailgaters
I have a friend that was being tailgated, he slows down to get the tailgater to slow down, doesn't work, he pumps the brakes, nothing, goes alittle further and pumps breaks again, still tailgating, eventually tailgater turns. My friend gets home and gets a call from police saying he got a call from someone that he was driving recklessly. He ends up going to court over this, the officer that made the call about him driving recklessly(who didn't even witness the tailgating incident) was at the hearing defending the tailgater!! The District Magistrate rules against my friend!! Now he has to pay a fine, gets 3 points, and everytime he goes through this particular area has to pull over and let cars go by that are tailgating!! My friend is going to appeal the ruling. Everyone we talk to can't believe the ruling, police officials, D.A., etc. He cannot afford a lawyer. He has checked into free legal aid, nothing. What are his chances and what advice could you give him?

Re: Slowing Down Tailgaters
Your friend has a good case for appeal. The driver who was tailgating must testify, not the officer who did not witness the event. I offer offer reduced/no fee representation to those in financial difficulty. my email is [email protected]
