Legal Question in Traffic Law in Pennsylvania

Speedy

Hello,

I know you have 45 days to a speedy trial. I was pulled over in Pa speeding. I payed the bail via certified mail. When does the 45 days start? Is it from the date your pulled over?

Thank You.

James

Re: Speedy

Well, James, I am not sure to what speed trial rule you are referring that claims to limit the prosecution to 45 days, but since you were pulled over for speeding and handed a citation, the charges wre validly filed within the 30 day time limit. You have paid the collateral and I assume you plead not guilty and requested a hearing date be scheduled. IF you have been waiting a long time, I'd call the local DJ to whom you responded to check on the court date in case they sent your notice to the wrong address.

Other than that, I am not aware of any 45 day time limit on traffic citations or any other time limits concerning citations once you have responded to them and are waiting for a hearing date to be set.
