Legal Question in Traffic Law in Pennsylvania

suspended licence

My daughter wrote a $10 bad check to the state. They suspended her licence till she paid 40 some(not sure of the exact amount). She paid that and went to the licence place to get her licence. They told her she would have to wait for a paper from Harrisburg. She finally called them and they said they had recieved the money monthes ago and her driving priviledges were restored. She started driving and got stopped. She got a fine to which she pleaded innocent on.The officer told her that if he had to go into court that he would slap her with another fine so she changed her plea. Now Harrisburg has suspended her licence for one year.Is there anything she can do to fix this? She depends on driving for her job.

Re: suspended licence

Well, she should never have plead guilty to whatever she was charged with by the officer. If that happened in the last 30 days, she should go to the clerk of courts in the county where it occurred and file an appeal from the plea she entered at the district justice.

The officer CANNOT add another charge at this point.

If it's beyond the 30 days, (but not by too many days) I would suggest that she find an attorney who can file a motion to allow her to file an appeal "nunc pro tunc", which basically means allow her to file it late.

You didn't put your zip code down on the form, so I'm not sure where you're located, but if you're in western PA, feel free to contact me about it.
