Arrangements of Property before Death of Mother

My sister and I are the only heirs to my mothers house. My sister and mother made an arrangement that my sister would move in with her and basically live in the house that would be hers and mine when mom died. The home was valued at 53,000 time when she moved in, she made improvements and changes. She(sister)now finds it difficult to care for mom and wants to charge me $1000 per year off the money to aid her in caring for mom, can she do this? Mom is telling me will covers me so I will not be cheated, but I have nothing stating she will pay me the 26500.

Can I demand the money now? Since she is living in the home and reaping her benefits now.

As long as your mother is alive, she can do anything she wants with her property. A will is merely a statement by someone as to what he/she wants done with his/her property at the time of her death. You should have an attorney prepare a contract between you and your sister stating that IF your mother still ownes the property at the time of her death AND she leaves it equally to you and your sister, then your sister will repay you for whatever you have contributed to your mother's care.
