my aunt dying without a will

my aunt is dying(cancer) she has only my mom her sister and her 3 neices and nephews me and my 2 brothers also i've taking care of her cat since she was put in hospice do me and my brothers have an inheritance coming to us or just my mom also what about the cat does she have any rights?

Dear Suzie:

If your aunt dies without a Will, she will be presumed to have died intestate. As such, her estate will pass in accordance with Pennsylvania law which, in this case, means that you mom will be the sole heir of the estate. Of course, this is presuming that your aunt didn't have any other siblings that died before her that had children of their own. If so, then those nieces and nephews would also be heirs. Namely, the only way that you or your brothers would have any interest in the estate would be if your mother had predeceased her sister.
