Legal Question in Wills and Trusts in Pennsylvania

My brother recently died without a will. The only family members left are my mother and I. I understand she is next of kin and will receive all assets. Does she have to contact a lawyer to do so? She would like to sign over his car to me, how would we go about the title transfer? Thank you for you time.

Whether or not your brother's estate has to be probated depends on many different things. What did he own at the time of his death and how were those things titled? Did he own real estate? Bank accounts? Was the car paid off? If the car was not paid off, your mother will not be able to transfer title to you or anyone else without first opening the estate and making arrangements to payoff the vehicle. Also, if he owned real estate and bank accounts, it is likely that she will have to open his estate.
