my mom died and has cd,s made out to my brother and me. ther in trust for me and my brother upon death. can we go to the bank and get them?

If your mother's CD's are "In-Trust" for you and your brother, then you can go to the bank with one of her certified Death Certificates and close out the accounts. However, please be aware that such holding are still subject to Pennsylvania inheritance tax and such a return will still need to be filed on behalf of her estate. Likewise, are the CD's the only assets that she owned at the time of her death? Did she have any other accounts, stocks or real estate holdings? If so, you and your brother may actually have to probate her estate.
