Legal Question in Wills and Trusts in Pennsylvania

Claiming property listed in a will

My ex-husband died 2 years ago and left all of his possessions to our daughters. He also made me executor of his will. He had a coin collection which is in his sister's possession and she refuses to give it to my children. What legal rights do I have as executor of his estate or what rights do the children have? The oldest is now 18.

Re: Claiming property listed in a will

You as the Executrix have all the rights that your ex-husband had prior to his passing, you essentially step into his footsteps to wind up his affairs. Accordingly, you do have a right and an obligation to go after his sister for the coin collection.

The estate process can be very complex so I would definitely consult a lawyer.

I do give free initial consultations to discuss your estate, what needs to be done and how much I would charge to represent you if you choose to have me represent you. Feel free to contact me 412.731.0865.
