Legal Question in Wills and Trusts in Pennsylvania

contents of home given to me

In Penn, my mother deeded her vacation home to me with life tenancy for her. She just died and gave all tangible assests to my three brothers. THey assume that means the contents of the vacation home, too. Does it since the building itself was in my ownership?

Re: contents of home given to me

Condolences on your loss.

Did you furnish the vacation home or were the contents your mother's?

If title to the home was yours, by a deed from your mother prior to her death, the land and the building are yours, and were not part of her estate.

Your mother may have left other assets to your brothers to equalize the distribution of her assets, since she had already given you the vacation home.

It's best that no one "assume" anything, but that the executor have the assistance of an estates lawyer to correctly administer the estate. If your interest differ from those of your brothers', you should get a separate lawyer.

If there was no Will [an intestate estate], it is even more important that an estates lawyer advise how the estate should be administered and divided, since State law governs intestate estates.

The estate should be administered in the State and County where your mother resided. If she did not reside in PA, then additional administration may be required in PA [and any other state where she had property, whether real estate or personal or other property,] to dispose of all of her property owned by her at her death.
